ADVANCED SCOPE
Compliance is a publishing capability, not a footer
Affiliate compliance spans law, advertising standards, privacy, intellectual property, platform rules, affiliate agreements and the advertiser’s written permissions. These layers overlap but are not interchangeable. Passing a network review does not prove legal compliance; adding a disclosure does not make an unsupported claim truthful.
This module provides an operational framework rather than jurisdiction-specific legal advice. Apply the strictest relevant control until a competent owner resolves uncertainty. For regulated products, material contracts, children, sensitive data or cross-border campaigns, obtain qualified legal and tax advice before publication.
Any operator must be able to pause a promotion when consumer harm, unlawful claims, missing permission, data exposure or material offer inaccuracy is credible. Revenue pressure never overrides a safety stop.

Create an obligation register with source URL or signed document, jurisdiction, affected assets, effective date, reviewer, required action and next review. Archive the actual version relied upon; bookmarks alone do not preserve changed terms.
RISK MODEL
Prioritize harm and irreversibility before probability
Score each promotion by plausible consumer harm, regulatory severity, contractual loss, account exposure, data sensitivity, reversibility and likelihood. Do not let a low estimated probability hide catastrophic impact. A health claim with weak evidence, for example, deserves stronger review than a minor formatting issue even at low traffic.

Material ambiguity, regulated category, sensitive audience or cross-border complexity.

Higher-risk claims, tracking, incentives or partner permissions need two-person approval.

COMMERCIAL DISCLOSURE
Make the relationship understandable before it affects the decision
The FTC states that endorsements must be honest and not misleading and that unexpected material connections affecting credibility should be disclosed clearly and conspicuously. ASA guidance similarly requires affiliate marketing to be obviously identifiable. Design for actual understanding rather than technical presence.
- place a plain-language disclosure near the recommendation or affiliate link;
- do not rely only on a global disclosure page, profile biography, vague “partner” label or terms link;
- repeat where a visitor may enter mid-page without seeing an earlier statement;
- match the medium: visible spoken and on-screen disclosure where video context requires it;
- disclose commission, free product, travel, discount, bonus or other material benefit when relevant;
- keep the disclosure readable on mobile, before truncation and away from competing visual noise;
- test meaning with people unfamiliar with affiliate marketing.
A disclosure does not cure a false ranking, fabricated experience or omitted limitation. Preserve editorial criteria regardless of commercial value.
CLAIMS GOVERNANCE
No material claim without scope, source and review date
Build a claim register for price, discount, performance, earnings, availability, security, compatibility, health, sustainability and comparative statements. Record exact wording, source, measurement method, market, qualifying conditions, owner, expiry and every asset using it.

PERMISSION MATRIX
Verify the precise method—not merely program membership
For every program and campaign, record whether content, email, paid search, paid social, display, coupons, trademark terms, merchant domains, deep links, retargeting, downloadable files, AI-assisted creative and sub-affiliates are allowed. Include geography, audience, approved creative and expiry.
Silence is not approval. Obtain written clarification when terms conflict or the intended method is absent. Preserve who approved what and under which governing version. A channel permission does not authorize inaccurate claims or unlawful tracking.
PRIVACY AND DATA
Collect the least data required for a defined purpose
EU data-protection rules require a lawful, transparent and purpose-bound approach to personal data. Map every identifier from browser or app through analytics, consent tools, affiliate redirects, networks and advertisers. Classify who determines purpose, who processes data, where transfers occur and how long evidence is retained.
- never place names, emails, phone numbers or other personal data in affiliate sub-IDs or URLs;
- separate essential operations from analytics and advertising choices;
- honor consent, withdrawal and applicable opt-out signals consistently;
- restrict access, rotate credentials and avoid shared administrator accounts;
- define deletion, retention, breach and data-subject request workflows;
- review server-side or conversion APIs as data transfers, not privacy bypasses;
- contractually govern processors and cross-border transfers where applicable.
INTELLECTUAL PROPERTY
Use only assets and marks you can prove you may use
Copyright generally protects original expression, while trademarks identify commercial origin. Program membership does not automatically grant unlimited rights to merchant photographs, logos, video, product feeds or copy. Follow the current brand and creative licence.
Maintain provenance for photographs, screenshots, quotations, music, fonts, data and AI-assisted assets. Record creator, licence, permitted edits, attribution, territory, expiry and source file. Do not remove watermarks, imitate official domains or imply endorsement by the merchant. Replace expired assets across cached and syndicated copies.
REGULATED CATEGORIES
Escalate when the wrong recommendation can materially harm someone
Finance, gambling, health, supplements, alcohol, age-restricted products, employment, credit, legal services and content directed at children may have market-specific licensing, targeting, warning and evidence requirements. Some programs or platforms prohibit them entirely.
Before acceptance, identify the regulator, required authorization, eligible audience, prohibited claims, geographic limits, age controls and complaint route. If expertise or verification is unavailable, exclude the offer. A disclaimer is not a substitute for authorization or substantiation.
PUBLISHING CONTROL
Require evidence before publication and revalidation after change

CONTINUOUS MONITORING
Control drift after the page passes review
Monitor broken links, redirected destinations, price and stock changes, expired promotions, merchant-page claims, program notices, reversals, complaint patterns and unauthorized content edits. Use risk-based review intervals: volatile promotions and regulated claims require faster checks than stable tutorials.
Automated checks find changes, not their legal meaning. Assign a human owner and response deadline. Maintain an inventory of every page and channel carrying each offer so one termination can trigger a complete update rather than a partial search.
INCIDENT RESPONSE
Contain first, then investigate without destroying evidence

Record detection, scope, versions, timestamps, decision owner, containment, notifications, root cause, correction and recurrence control. Do not quietly edit a serious incident before preserving what audiences actually saw.
CROSS-MARKET CHANGE CONTROL
Do not copy one country’s approval into another
Language, currency, delivery and domain targeting can expose content to several jurisdictions. Maintain market overlays for disclosure wording, consent, restricted products, price presentation, taxes, age limits and required legal entities. Geo-targeting reduces exposure but does not prove it.
When law, platform policy or program terms change, assess effective date, affected assets, grandfathering, required notices and rollback. Test localized pages independently and keep translations synchronized with the approved source claim.
EVIDENCE AND AUDIT
Retain enough evidence to reproduce the decision
An audit record should connect content version, claims, sources, permissions, disclosure, reviewer, rendered evidence, outbound destination and publication interval. Use role-based access, immutable history where proportionate, defined retention and deletion. Never retain personal data merely because it might be useful later.
Sample high-risk and ordinary content, not only known failures. Track overdue reviews, expired evidence, unsupported claims, missing disclosures, unresolved incidents and repeat root causes. Compliance completion counts are not proof that controls work.

Do not state that every visitor receives 20% off unless the exact offer proves it for that visitor’s plan, market and purchase conditions. A dynamic landing page can change after publication, so the original evidence and ongoing monitoring are both necessary.
FAILURE-FIRST REVIEW
How compliance systems fail in practice
- treating a footer disclosure as permission for every commercial claim;
- copying merchant text without verifying evidence, market or expiry;
- assuming network acceptance authorizes every channel and brand term;
- hiding material connections behind vague labels or collapsed text;
- passing identity through affiliate URLs or server-side integrations;
- using logos, photographs, reviews or music without provable rights;
- publishing regulated offers without required expertise or authorization;
- reviewing source code but not the actual mobile rendering;
- allowing promotions and prices to drift after publication;
- silently correcting serious incidents without evidence preservation;
- using automation as the final legal decision-maker;
- expanding one market’s approval globally without jurisdiction review.

An independent reviewer can reconstruct what audiences saw, why every material claim was allowed, which commercial connection existed, what data and assets were used, who approved publication and how the promotion will be corrected or stopped.

A reviewer should be able to trace the proposed action to its evidence, identify the largest unresolved assumption and explain the next check. Keep observations, hypotheses and planned tests distinct.
